WARNING: If the user is a resident of Arizona, Arkansas, Connecticut, Florida, Iowa, Louisiana, Maryland, Montana, North Dakota, Puerto Rico, Quebec, Tennessee and Vermont, the user is not permitted to participate in this game to win any cash prizes.
 1 - What is The Prison Inmate? "The Prison Inmate" is an Internet-based multiplayer game that allows you to play characters based on the real prison life. The Prison Inmate can be accessed via the URL http://www.theprisoninmate.com. Please read the quick guide on how to get started. The Prison Inmate is open to players aged eighteen (18) and above. By clicking the "Sign Up" button you confirm that you fulfill this requirement. 2 - What do you need to play? The Prison Inmate is completely browser-based. You do not need to download any Software. All you need in order to play the game is a standard-browser (MS Internet Explorer 5.5 or higher, Netscape 6.0 or higher, Firefox 1.0.4 or higher) and an internet connection. 3- Agreement With acccepting these terms and condition you are entering into a formal Agreement with "Karim Tagemouati", the owner of The Prison Inmate. The Prison Inmate may revise or amend this Agreement at any time, and such revision shall be effective thirty (30) days after a respective notification to you. If any such revision is unacceptable to you, you may terminate your membership within thirty (30) days following such notification. 4- Account In order to use The Prison Inmate you will have to create a user account. Please note that is not allowed to have more than one (1) account. Accounts may not be shared, transferred or otherwise used by more than one player. You will be asked to choose a name ("Inmate Name") to identify yourself to other members and the staff. Your username will be always reserved as a business name for you so that you are the only who is able to use it. You may not select as a Game Name the name of another person, or a name which infringes trade or service marks, copyrights, other intellectual property right, or personal rights, or a Game Name that is offensive or vulgar. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your account. You agree to immediately notify The Prison Inmate of any unauthorized use of your account or any other breach of security. You agree to provide true, accurate, current and complete information in the registration process. If The Prison Inmate has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, The Prison Inmate has the right to suspend or terminate your Account and refuse any and all current or future use of The Prison Inmate. 5 - License and Intellectual Property Subject to the terms of this Agreement, The Prison Inmate grants you, for your personal use only, a non-exclusive, non-transferable license to use The Prison Inmate for a period as defined in this agreement. You may not (a) sublicense, rent, lease, loan or otherwise transfer The Prison Inmate or your account; (b) modify, adapt, reverse engineer or decompile The Prison Inmate in whole or part, or otherwise attempt to derive source code from The Prison Inmate; (c) create any derivative works in respect of The Prison Inmate; or (d) otherwise use The Prison Inmate except as expressly provided in this Agreement. Notwithstanding the foregoing, The Prison Inmate grants to you the right to use the specifically designated game content for non-commercial, personal purposes, including in connection with creating non-commercial fan fiction, fan web sites regarding the same or for banners and links to the The Prison Inmate website. In case you are allowed to upload to or create content in The Prison Inmate and with respect to your The Prison Inmate character, you grant to The Prison Inmate a non-exclusive, universal, perpetual, irrevocable, royalty-free, sublicenseable right to exercise all rights of any kind or nature associated with such content, and all ancillary and subsidiary rights thereto, in any languages and media now known or not currently known. 6 - Charges You can play "The Prison Inmate" without any limitations for free. However, You may choose to buy additonal credits or subscriptions. Pricing and billing information can be found in the "Turns" section on the The Prison Inmate website. Paid fees are not refundable. 7 - Rights and Responsibilities You understand that you have no expectation of privacy regarding the communications you make on the Service, and that all communications made by or received from you may be monitored by The Prison Inmate. You agree not to use The Prison Inmate in any other way than originally intended including but not limited to not: * § upload, post, email or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation; * § interfere with or disrupt The Prison Inmate or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service; or * § attempt to gain access to any other Player's Game account; or * § stalk or otherwise harass another Player. 8 - Availability and Access You agree that The Prison Inmate will not be liable for any interruption of The Prison Inmate, delay or failure to perform resulting from any cause whatsoever. You acknowledge that The Prison Inmate may be interrupted for reasons beyond the control of The Prison Inmate, and The Prison Inmate cannot guarantee that you will be able to access The Prison Inmate whenever you may wish to do so. The Prison Inmate shall not be obligated to refund all or any portion of any fees paid by reason of any interruption of The Prison Inmate. The Prison Inmate has the right at any time for any reason or no reason to change and/or eliminate any aspect of The Prison Inmate as it sees fit in its sole discretion. 9 - Term and Termination The Prison Inmate reserves the right to terminate this Agreements and delete your Account immediately and without notice if you breach this Agreement or wilfully infringe any third party intellectual property rights, or if The Prison Inmate is unable to verify or authenticate any information you provide to The Prison Inmate, or upon game play, chat or any of your activities whatsoever which is, in The Prison Inmate sole discretion, inappropriate and/or in violation of the spirit of The Prison Inmate as described in the Game Rules. In the event the Agreement has been terminated for such reasons you may not create another account without the expressed constent of The Prison Inmate. Fees paid will not be refunded. The Prison Inmate may choose to terminate The Prison Inmate entirely. In this event he will notify all users at least fourty-five (45) days in advance. 10 - General Provisions. You may not use, copy, modify, sublicense, rent, sell, assign or transfer the rights or obligations granted to you in this Agreement, except as expressly provided in this Agreement. If any provision of this Agreement is held to be unenforceable for any reason, such provision shall be reformed only to the extent necessary to make it enforceable, and such decision shall not affect the enforceability of: (a) such provision under other circumstances, or (b) the remaining provisions hereof under all circumstances. Notwithstanding anything else in this Agreement, no default, delay or failure to perform on the part of The Prison Inmate shall be considered a breach of this Agreement if such default, delay or failure to perform is shown to be due to causes beyond the reasonable control of The Prison Inmate. 11 - Choice of Law. This Agreement is governed by and construed under the laws of Canada. |
